TERMS & CONDITIONS
This Warranty/ Returns Policy (herein referred as the “Policy”) applies to purchased goods under the VIBE BRAND through OZLITE PTY LTD (here after referred to as the supplier).
All other products, OZLITE PTY LTD acts as a reseller, therefore any warranties/returns and defective products must be referred to original manufacturers policies for claims.
OZLITE PTY LTD shall not be bound by nor responsible for any terms, conditions, representation or warranty other than that which is given by the original manufacturer of the goods.
GOODS; means the product that was purchased
You; means you, the original end user, purchaser of the Goods the entity acquiring the Goods
EFFECT OF LEGISLATION;
Notwithstanding any other provision of these terms and conditions, nothing in these terms and conditions is to be read as excluding, restricting or modifying the application of any legislation which by law cannot be excluded, restricted of modified.
The related warranty period for each product is stated on the packaging and/or Specification data sheets. As noted on our website www.vibelighting.com.au
This warranty period starts on the date of purchase from the supplier. Replacement goods shall be warranted for the balance of time remaining within the warranty period of the original product.
The obligation of the supplier under this warranty is expressly limited to repair, replacement or refund of the Goods, at the sole discretion of the supplier. Defective Products within the Warranty Period, and only after the Supplier has issued a “Goods Return Authority” (GRA) to You for the Goods.
Cost of packaging and returning the Goods to the location specified by the Supplier are to be borne by you.
Labour costs for (de)-installation or (de)-integration associated with the replacement goods are not covered under this warranty. Unless written variation is given from the Supplier.
Replacement Goods will be equivalent in function, but not necessarily identical to the replaced goods. Repair, replacement or refund as contained in this warranty is the sole and exclusive remedy under this warranty.
This warranty only covers goods applied within their “Intended” or “normal” use as defined by:
Operating conditions are in accordance with the information on the Product and its packaging and Specification Data Sheet
Goods installed as per installation instructions supplied with each product AND
Warrant applies only when using compatible control gear/dimmers (as noted in datasheets and applications notes)
Goods subjected to abuse, misuse, neglect, negligence, accident, improper testing or service, improper installation or removal and reinstallation, improper storage, improper handling, improper repair, abnormal physical stress, chemical reaction, abnormal environmental conditions beyond those described in the product specifications, including but not limited to excessive ambient temperatures, sustained or temporary over-voltages, damages caused by direct or near-hit lighting strikes, excessive switching, or any other use contrary to instructions or Product specifications issued by the supplier.
ACCEPTANCE OF GOODS
The buyer must inspect the Goods provided by the Seller immediately upon delivery of the Goods
In the event that the goods are damaged, defective or do not comply with the Buyers order. The buyer must within 7 days of delivery of the goods, give written notice to the Seller with details of why the goods have been rejected. Failure to do so, the goods will be deemed to have been accepted by the Buyer and the Buyer must pay for the goods in accordance with the Term and Conditions.
The buyer must not return any goods unless
The Seller has first given written approval for their return
The goods are returned with the Sellers return authorisation reference number
The goods must be returned in original package and in saleable condition
In the event that the goods are
Goods manufactured to order are non-returnable unless those goods do not conform to approved specifications/drawings or are otherwise proven to be defective.
In the event the Goods are defective the Seller shall bear the cost of shipping the Goods back to us, as well as shipping cost of any replacement
All other returns that (Other than defective Goods) the buyer shall bear the cost of shipping the Goods back to the Seller.
In the event that the goods are claimed to be defective, if after testing the goods are proved not to be defective. Then the buyer is liable to pay for the costs if any inspection and shipping and collection cost of the returned product.
